Miscellaneous applications

Think of a criminal case as a long local train journey. The big moments are the charge, the evidence and the verdict, but most of what actually happens on the platform are small requests: “please allow me to sit out of the next hearing”, “please give me my scooter back”, “please call for the bank’s records”. In court each of those small requests is a written application. They never make headlines, yet an exam paper loves them. How is one drafted, and which section does it stand on?

A miscellaneous application is a short written request to a criminal court, made inside a pending case, asking for an interim or procedural order; each rests on a particular provision of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), such as s.228 for exemption from personal appearance, s.346 for adjournment, s.497 for custody of property, s.94 for production of documents and s.359 for compounding.
