Selected opinions of the Disciplinary Committee of Bar Councils and Major Judgments of the Supreme Court on the subject
Every law student eventually hears the line “the Bar Council will take your licence.” Few ask who has actually done it, for what, and whether the Supreme Court has ever said the Bar Council was the wrong body to do it. This topic is where the statute meets real decisions. The Bar Council of India’s syllabus asks you to study selected opinions of the disciplinary committees of the Bar Councils and the Supreme Court’s major judgments on discipline, so that the sections of the Advocates Act stop being abstractions and become rules you can apply to facts.
In two minutes
Learn this topic in two layers: the Supreme Court’s principles on who disciplines advocates and how (that discipline is the Bar Council’s job, the proceedings are of their own kind, and strikes and contempt are dealt with separately), and the pattern of disciplinary opinions, which apply the Bar Council Rules on duty to court, client, opponent and colleagues.
