Appeal and revision

You lose a case in the first court and ask, “Who can I go to next?” Every statute has to answer that, and the Code gives different answers depending on what kind of order you are unhappy with. An order in a company’s insolvency goes one way. An order of the Board refusing registration goes another. A conviction for an offence under the Code goes a third. Section 237 covers only the last of these, and the first step in any answer is knowing which path you are on.

In two minutes

Section 237 gives the High Court the appellate and revisional powers of the criminal procedure law over the Special Court that tries offences under the Code; civil-side appeals run separately, from the NCLT to the NCLAT (s.61) and then to the Supreme Court on a question of law (s.62).
