Adoption Deed under Juvenile Justice Act, 2015
A couple in Nerul who have no children decide to adopt the son of the husband's younger brother, who can no longer look after him. The families agree, the child is happy, and a lawyer is asked to draw up an adoption deed. But adoption is not like selling a flat: the law does not let the two families simply agree. A child's whole family tie is being replaced by another. Who checks that this is right for the child, and what exactly does the paper you draft record?
In two minutes
Under the Juvenile Justice (Care and Protection of Children) Act 2015 adoption is completed by an order of the District Magistrate after the statutory checks (s.61), and on that order the child becomes the child of the adoptive parents for all purposes with the old family ties severed (s.63); any adoption deed is a supporting record, not a substitute for the order.
