Essentials of a suit

Your landlord in Vashi has kept your deposit for eight months and stopped answering calls. A lawyer friend says, just file a suit. But a suit is not a complaint on WhatsApp or a letter to the police. The court will want to know who is suing whom, about what, why now, what you want, and whether this is a matter a civil court can hear at all. Miss one of those and your plaint can be returned or thrown out before anyone looks at your proof. What exactly must be present for something to count as a proper suit?

A proper suit needs opposing parties, a cause of action, a subject-matter and a relief, it must be of a civil nature and not barred, and it must be started in a competent court by a plaint that meets Orders VI and VII.
