Place of suing
Your uncle owns a plot at Panvel, lives in Pune and runs his business from Nashik. A man in Kolhapur has been dumping rubble on the plot. Your uncle wants him stopped. Which court should he go to: Panvel, where the plot is, Kolhapur, where the man lives, Pune, where your uncle lives, or Nashik? A wrong choice can cost him months, because the suit may be returned and have to be started again. The Code answers this in a short run of sections, and the answer changes with what the suit is about.
In two minutes
Place of suing is settled by the nature of the suit: property suits go where the property lies (s.16), wrongs to person or movables can go where the wrong was done or the defendant is (s.19), and all other suits go where the defendant lives or works or where the cause of action arises (s.20).
