Concept — definitions, registrations and Duties of Employer and Employee
A call-centre in Belapur has sixty staff, half of them hired through a manpower agency. The manager asks: are we registered anywhere, who is responsible if someone is hurt, and do the agency people count? Every one of those questions is answered by the opening chapters of the OSH Code. Before any safety rule can bite, the law has to settle who is an employer, who is a worker, and which workplace is an establishment that must register.
In two minutes
Chapters I to III of the OSH Code fix the vocabulary (employer, employee, worker, establishment, contractor), require electronic registration within sixty days, and then impose duties on employers, designers, architects and employees, with a matching set of employee rights.
