Offences and Penalties

Suppose a scaffold collapses on a Navi Mumbai construction site and a worker dies. The builder says the contractor was responsible; the contractor says he only supplied labour; the company says its directors never visited the site. Who goes to court, what can the court impose, and could the matter have been settled for money instead? Chapter XII of the OSH Code answers these questions in twenty-one sections, and the answers are more varied than students expect: some breaches attract only a penalty, some a jail term, and a large class can be compounded.

In two minutes

Chapter XII (ss.94 to 114) sorts breaches of the OSH Code into money penalties imposed by an officer, offences punishable with imprisonment or fine, and accident-linked offences, with a thirty-day chance to comply, company and nominee rules, and composition at fifty or seventy-five per cent of the maximum.
