Social Security Fund
A woman who stitches garments at home in Dharavi, a rickshaw driver in Thane and a porter at Vashi market are all 'unorganised workers': no fixed employer, no provident fund, often no insurance. Where could a government find money to help them? One answer is to take the money that employers pay when they break safety law and put it to work for the people the law failed to protect. That is the idea behind section 115 of the OSH Code, which creates a social security fund for unorganised workers and feeds it with penalties and composition amounts.
In two minutes
Section 115 of the OSH Code requires the appropriate Government to establish a social security fund for the welfare of unorganised workers, credited with penalties imposed under s.111(6) and composition money under s.114(4), plus any other prescribed sources, and spent as the Government prescribes.
